Welcome to GoBeyond ("GoBeyond", "we", "our", or "us"). These Terms of Service ("Terms") govern your access to and use of our website and services. By accessing our website or purchasing our services, you agree to be bound by these Terms.
01Services
GoBeyond provides professional digital services, including but not limited to:
- Custom website development
- Web application development
- UI/UX implementation
- Website maintenance
- Bug fixing and technical support
- API integrations
- Performance optimization
- E-commerce development
- Other software development and consulting services
The scope of each project will be defined in an individual proposal, quotation, invoice, or written agreement.
02Eligibility
You must be at least 18 years old and legally capable of entering into binding agreements to use our services.
03Quotes and Project Approval
Project estimates are based on the information provided by the client.
Additional work requested after project approval may require a revised quotation and additional fees.
Work will begin only after both parties agree to the project scope and any required initial payment has been received.
04Client Responsibilities
The client agrees to:
- Provide accurate information.
- Supply required content, images, branding, and materials.
- Respond to requests for feedback in a timely manner.
- Ensure they have the legal rights to all materials they provide.
Delays in providing required materials may affect delivery timelines.
05Payments
Payment terms will be communicated before work begins.
Unless otherwise agreed:
- Payments are due according to the agreed schedule.
- Late payments may delay project delivery.
- All fees are non-refundable once work has commenced unless otherwise required by law.
Clients are responsible for any taxes or fees applicable in their jurisdiction.
06Intellectual Property
Unless otherwise agreed in writing:
- Clients retain ownership of the content they provide.
- Upon full payment, ownership of the completed custom work is transferred to the client.
- GoBeyond retains ownership of pre-existing tools, templates, libraries, frameworks, and proprietary development methods used during the project.
We may display completed projects in our portfolio unless the client requests confidentiality in writing.
07Revisions
Reasonable revisions included in the agreed project scope will be completed at no additional charge.
Requests outside the agreed scope may be billed separately.
08Delivery
Estimated delivery dates are provided in good faith but are not guaranteed.
Project timelines may change due to:
- Client delays
- Changes in project requirements
- Technical issues outside our control
- Force majeure events
09Acceptable Use
Clients agree not to use our services for unlawful activities, including but not limited to:
- Fraud
- Intellectual property infringement
- Distribution of malware
- Spam
- Unauthorized access to computer systems
- Any activity prohibited by applicable law
We reserve the right to refuse or terminate services that violate these Terms or applicable laws.
10Third-Party Services
Projects may integrate third-party platforms, APIs, hosting providers, or software.
GoBeyond is not responsible for outages, pricing changes, policy changes, or service interruptions caused by third-party providers.
11Warranties
We warrant that services will be performed with reasonable care and professional skill.
Except as expressly stated, services are provided "as is" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
12Limitation of Liability
To the maximum extent permitted by law, GoBeyond shall not be liable for indirect, incidental, consequential, special, or punitive damages, including loss of profits, revenue, business opportunities, or data.
Our total liability arising from any claim related to our services shall not exceed the amount paid by the client for the specific services giving rise to the claim.
13Indemnification
Clients agree to indemnify and hold GoBeyond harmless from claims, damages, liabilities, costs, or expenses arising from:
- Materials supplied by the client.
- Misuse of our services.
- Violation of these Terms.
- Violation of applicable laws or third-party rights.
14Termination
Either party may terminate a project by providing written notice.
The client remains responsible for payment for all work completed up to the termination date.
GoBeyond reserves the right to suspend or terminate services for violations of these Terms or non-payment.
15Confidentiality
Both parties agree to maintain the confidentiality of proprietary or confidential information shared during the course of a project unless disclosure is required by law or authorized in writing.
16Governing Law
These Terms shall be governed by and interpreted in accordance with the applicable laws of the jurisdiction in which GoBeyond operates, without regard to conflict of law principles.
17Changes to These Terms
We may update these Terms from time to time.
Updated versions become effective upon publication on our website.
Continued use of our website or services constitutes acceptance of the revised Terms.
